Terms of service

1. Agreement

These terms are an agreement between you (the person or organization installing EnrollCue) and Akia marketing Inc. (“we”). By installing or using EnrollCue, you accept them. If you accept them for an organization, you confirm that you can bind it.

2. The service

EnrollCue is an app for HubSpot that enrolls contacts in HubSpot sequences, and unenrolls them, from workflows, and related features described on enrollcue.com. It relies on HubSpot: changes HubSpot makes to its products or APIs may affect EnrollCue.

3. Your responsibilities

• Keep a HubSpot subscription and seats that allow you to use workflows and sequences.
• Use EnrollCue in compliance with the law, including anti-spam laws (such as Canada's CASL and the U.S. CAN-SPAM Act) and privacy laws, and with HubSpot's terms. You are responsible for having the consent required to email your contacts.
• Don't use EnrollCue to send unsolicited bulk email, to attempt to circumvent limits, or to disrupt the service.

4. Plans, billing and cancellation

• The Free plan is free within its monthly limit. Paid plans are billed in advance, monthly or yearly, at the prices shown on our pricing page, in US dollars, plus applicable taxes.
• Paid plans renew automatically until cancelled. You can cancel at any time; the cancellation takes effect at the end of the period already paid, and paid periods are not refunded except where the law requires it.
• We may change prices with at least 30 days' notice; the change applies from your next renewal.

5. Your data

Your data stays yours. We process it only to provide EnrollCue, as described in our privacy policy.

6. Availability

We work to keep EnrollCue available and reliable, but we don't guarantee uninterrupted service. Maintenance, HubSpot outages or limits can delay enrollments.

7. Intellectual property

EnrollCue, its code and its brand belong to us. You receive a non-exclusive, non-transferable right to use EnrollCue during your subscription.

8. Suspension and termination

We may suspend or end access in case of a serious breach of these terms, non-payment, or a risk to the service or to others. You can stop using EnrollCue at any time by uninstalling it.

9. Warranties and liability

EnrollCue is provided “as is”, to the extent permitted by law. Our total liability is limited to the amounts you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect damages, such as lost profits or lost data, to the extent permitted by law. Nothing in these terms limits rights that the law does not allow to be limited, including those of consumers.

10. Changes to these terms

We'll post any change on this page and email account holders about significant changes at least 30 days in advance.

11. Governing law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there.
